The petitioner is languishing in custody since 26.01.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that from the possession of the petitioner, 4.5 litres of Nepali country made liquor were recovered. It is submitted by learned counsel for the petitioner has maliciously been framed in the present case and the petitioner is accused in two other cases of similar nature and in both the cases, he is on bail.

Learned APP for the State submits that the petitioner is habitual offender.

Considering the quantity of recovery and the period

Patna High Court CR. MISC. No.16156 of 2019(2) dt.15-03-2019 2/2 under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Excise Case No.66 of 2019.
