The appellants seek pre-arrest bail in connection with Darauli P.S. Case No. 46 of 2016 registered under Sections 143, 147, 148, 149, 151, 341, 342, 323, 307, 332, 333, 337, 338, 188, 353, 427, 504, 506, 120B of the Indian Penal Code and Section 3(i), 3 (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Submission of learned counsel for the appellants is that similarly situated several co-accused persons have already been allowed bail by a Bench of this Court vide Cr. Appeal (SJ) No. 177 of 2019 on 08.02.2019 and Cr. Appeal

Patna High Court CR. APP (SJ) No.938 of 2019 dt.20-05-2019 2/2 (SJ) No. 346 of 2019 on 31.01.2019.

Having heard both sides and in the facts and circumstances of the case, let the above named appellants be released on bail, in the event of arrest or surrender, on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cumSpecial Judge, SC/ST Act, Siwan in connection with Darauli P.S. Case No. 46 of 2016, subject to the conditions as laid down under section 438(2) of Cr. P.C.

Accordingly, the appeal is allowed and the impugned order is set aside.
