The petitioner seeks bail in Mairwa P.S. Case No. 319 of 2017 registered for the offence punishable under Section 30(A) and 38(A) of the Bihar Excise & Prohibition Act, 2016. Informant who is A.S.I. in his written report has alleged that he was on patrolling duty on 02.09.2017 and at about 4:00 pm when he reached near Laxmipur Over Bridge, a person coming on motorcycle after seeing the police left the motorcycle bearing no. BR 29J 0840 and fled away. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case as petitioner was earlier arrested in Excise Act. It has been further submitted that nothing has been recovered from the possession
Patna High Court Cr.Misc. No.30263 of 2018(2) dt.16-05-2018 2/2 of the petitioner. The owner of the motorcycle is Md. Taufiq. Petitioner is in custody since 06.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Mairwa P.S. Case No. 319 of 2017. (S. Kumar, J) ranjan/- U
