====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 16-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In the present case, the petitioner seeks bail in connection with Mairwa P.S. Case No. 264 of 2024, registered for the offences under Sections 80(2), 3(5) of the B.N.S in which charges have been framed under 103(1), 80(2), 3(5) of the B.N.S.
3. As per the prosecution case, the petitioner and other co-accused persons caused dowry death of the daughter of the informant.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the father-in-law of the deceased and from the perusal of the FIR it appears that the
Patna High Court CR. MISC. No.17998 of 2025(2) dt.16-04-2025 2/3 allegation of demand of dowry and torture is mainly against the co-accused husband of the deceased. Learned counsel further submits that the petitioner never demanded any dowry and never tortured the daughter of the informant. During investigation independent witness stated about deceased locking herself in the room and hanging herself with the help of rope fastening it in the ceiling fan. Even during investigation nothing came up against this petitioner. The petitioner is in custody since 10.08.2024 and charge sheet has been submitted. The petitioner has got no criminal antecedent.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the non-specific nature of allegation against the petitioner and further considering submission of charge sheet and period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-II, Siwan/concerned court, in connection with Mairwa P.S. Case No. 264 of 2024, subject to the condition laid down under
Patna High Court CR. MISC. No.17998 of 2025(2) dt.16-04-2025 3/3 Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
