The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that the accused persons forcibly harvested wheat crop of the informant and, on protest, Vinay Singh (petitioner no. 2) and Madhusudan Singh fired but the same did not hit anyone. Submission is that Vinay Singh, petitioner no. 2, also lodged Dumariyaghat P.S. Case No. 36 of 2014 against the informant and others. The informant is a man of Krishna Singh and the present case is filed only to create a defence case.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender in the court below within four weeks from today, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Dumariyaghat P.S. Case No. 41 of 2014, corresponding to G.R. No. 1633 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
