2. The petitioner apprehends his arrest in connection with Musri Gharari P.S. Case No. 97 of 2023 registered under Sections 461 and 379 of the Indian Penal Code.
3. It is alleged that petitioner committed theft of 36 bags of castor cake. He was identified through C.C.T.V. footage.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has been working in the industry of the informant since long and there was dues of Rs. 25,000/- of wages of the petitioner upon the informant. When the petitioner demanded his dues this false case and concocted case has been lodged
Patna High Court CR. MISC. No.17458 of 2024(3) dt.01-05-2024 2/2 against him. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got no criminal antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-Icum-Additional Munsif, Samastipur in connection with Musri Gharari P.S. Case No. 97 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
