JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsel for the petitioner and the state. The present application has been filed for modification of order dated 22.11.2011 passed by Hon'ble Mr. Justice Akhilesh Chandra (since retired) in Cr. Misc. No.32641 of 2011 to the extent of modifying the additional condition whereby the petitioner was directed to attend the court regularly till the disposal of the case and in the event of failure on two consecutive dates, without any reasonable explanation, the privilege of anticipatory bail will be deemed to be cancelled.

It is submitted by learned counsel for the petitioner that the above modification is sought since the petitioner is Assistant Manager in Bharat Cooking Coal Ltd, posted at Dhanbad hence unable to come to Arwal regularly.

Considering the grounds taken in the modification petition, the additional condition of the order dated 22.11.2011 is modified to the

No.22157 of 2015 (3) dt.14-07-2015 2/2 extent that the learned court below shall be at liberty to cancel the bail bonds of the petitioner if the petitioner defaults during trial for three consecutive occasions without any reasonable explanation. Accordingly, the order dated 22.11.2011 passed in Cr. Misc. No.32641 of 2011 stands modified to the extent indicated above in connection with Complaint Case No. 65 of 2011 pending in the court of the learned SDJM Jehanabad.
