JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Bikramganj PS case no. 125 of 2009 instituted for the offences punishable under Sections 394, 395, 412 of Indian Penal Code. It appears from the record that the petitioner was granted bail by the learned trial court but he is said to have misused the privilege of bail for about 4 yrs. and 8 months. However, the petitioner has voluntary surrendered before the learned trial court below on 13.10.2017 itself and since then, he is languishing in jail custody.

No.28205 of 2018 (2) dt.09-05-2018 2/2 The learned counsel for the petitioner submits that since the petitioner had gone to Chennai for the purposes of his livelihood, the petitioner could not attend the proceedings of the Court below, however he undertakes to be present on each and every date so fixed by the learned trial court. It is further submitted that similarly situated co-accused person has already been granted bail by this Court.
Considering the aforesaid facts and circumstances as well as the submissions made on behalf of the learned counsel for the petitioner, I direct for release of the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-IVth, Rohtas at Sasaram in connection with Bikramganj PS case no. 125 of 2009.
