07-05-2018 Heard Sri Rajendra Narayan, learned senior counsel assisted by Sri Udai Shankar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Gardanibagh P.S. Case No. 80 of 2018 registered for offence under Sections 417/420 of the Indian Penal Code, has prayed for grant of bail. Learned senior counsel for the petitioner has firstly drawn my attention to statement made in paragraph 3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner was a candidate for appointment as Constable and he was detained on allegation that his fingerprint was not matching with the finger-print, which was obtained at the time of written test. Only on this very ground,
Patna High Court Cr.Misc. No.27740 of 2018(2) dt.07-05-2018 2/2 the petitioner has been taken into custody. It has also been argued that some of the other accused, having similar accusation, have already been granted bail by this Court. Considering the nature of accusation, clean antecedent as well as fact that some other accused persons having similar accusation have been extended the privilege of bail, there is no reason to refuse same relief to the petitioner. Let the petitioner namely Guddu Kumar Upadhay @ Guddu Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge XIV-cumA.C.J.M., Patna in connection with Gardanibagh P.S. Case No. 80 of 2018.
