2. The petitioner has filed the instant application for modification of the order dt. 11.10.2023 passed in Cr. Misc. No. 44671 of 2023 for the modification of order with respect to conditions for payment of Rs. 10,00,00/- (Ten Lakh) to informant in connection with Agamkuan P.S. Case No. 783 of 2022.

3. Earlier, the petitioner was enlarged on provisional bail with a direction to deposit the rest of the amount i.e. 5,00,000 (Five Lac) to the informant in five equal monthly installment and each installment would be of Rs. one lakh.

3. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.20552 of 2024(2) dt.13-03-2024 2/2 that both the parties had agreed to settle the dispute subject to condition of payment of Rs. Ten lakh to the informant and out of which, learned counsel for the petitioner had already handed over the demand draft of Rs. 5,00,000/- (Five Lakh). Subsequently, in compliance with the direction of this Court, the petitioner has deposited Rs. 3,00,000/- (Three Lakhs) out of the remaining amounts, thus making a total of Rs. 8,00,000/- has been deposited to the informant till 31.1.2024. So far as remaining 2 lakhs Rupees is concerned, the same has been waived off as per mutual consent between the petitioner and the informant.

4. Learned counsel for the informant submits that matter has been settled between the parties in respect of remaining amount of Rs. 2 lakhs. Now the informant has no objection.

4. In view of the the aforesaid facts and circumstance of the case, this modification application stands allowed to the extent that no any further amount is needed to be paid to the informant.
