This is an application for bail in connection with Parsa Bazar P.S. Case No. 129 of 2017 registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code and Sections 3, 4 & 10 of Bihar Conduct of Examination Act, 1981.
Allegation against the petitioner is of impersonation in appearing at the Examination of Staff Selection Commission on behalf of other candidate and he has been arrested at the examination hall.
Submission of learned counsel for the petitioner is that for such offence punishment is for six months under the Bihar Conduct of Examination Act, 1981 and petitioner is in custody for
Patna High Court Cr.Misc. No.40624 of 2017 (2) dt.04-09-2017 2/2 two months and he has no criminal antecedent. Heard learned APP also.
Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Patna, in connection with Parsa Bazar P.S. Case No. 129 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) If active involvement of the petitioner in such type of cases is found in future, the prosecution will be at liberty to move for cancellation of his bail bond.
