The petitioner is apprehending his arrest in connection with Pupri P.S. Case No. 12 of 2014 for the offences instituted under Section 384 of the IPC.

The prosecution story, in brief, is that the petitioner has taken possession over the land bearing Plot No. 2530 area 3 1⁄2 decimals of the informant Kailash Prasad Verma in VillageJhajhihar under Pupri P.S. and he wanted to give boundary over the said land. It is alleged further that on protest the petitioner threatened to commit murder or kidnap the family member of the informant.

No.21311 of 2015 (3) dt.04-09-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case due to land dispute. There is no specific allegation against the petitioner. From perusal of the F.I.R. itself it would appear that no offence under Section 384 of the IPC is made out.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Pupri P.S. Case No. 12 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri at Sitamarhi, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
