JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 The matter has been listed at the instance of the learned counsel for the petitioners.

It appears from the F.I.R that petitioner No. 2 Prakash Kumar Singh @ Rocky assaulted with sword to the informant's nephew Atul Abhisek on his head and the opinion with regard to the injuries of informant's nephew has been kept reserved and on basis of this fact, vide order dated 20.04.2016 the petitioner No. 2 Prakash Kumar Singh @ Rocky was directed to surrender before learned Court below within a period of six weeks and pray for regular bail and the other two petitioners being petitioner No. 1 and 3 were directed to be released on anticipatory bail since no grievous injury was alleged to have caused by petitioner Nos. 1 and 3. However, due to inadvertence, in paragraph 5 of the order, in place of

No.16838 of 2016 (3) dt.29-04-2016 2/2 petitioner No. 2 namely Prakash Kumar Singh @ Rocky, the name of petitioner No. 3 namely Avinash Raj @ Chotu singh @ Chotu has been recorded and in the last paragraph of the order, in place of petitioner Nos 1 and 3 namely Baliram Singh @ Balram Singh and Avinash Raj @ Chotu singh @ Chotu, it was wrongly recorded as petitioner Nos. 1 and 2 namely Baliram Singh @ Balram Singh and Prakash Kumar Singh @ Rocky and they were directed to be released on anticipatory bail.

Hence, the order dated 20.04.2016 is modified to the extent that in the 5th paragraph of the order, in place of petitioner No. 3 Avinash Raj @ Chotu Singh @ Chotu, let it be read as petitioner No. 2 namely Prakash Kumar Singh @ Rocky and in the last paragraph of the order, in place of petitioner Nos. 1 and 2 namely Baliram Singh @ Balram Singh and Prakash Kumar Singh @ Rocky, let it be read as petitioner Nos. 1 and 3 namely Baliram Singh @ Balram Singh and Avinash Raj @ Chotu singh @ Chotu.

The order dated 20.04.2016 stands modified to the extent as indicated above.
