2. Upon perusal of office record, it transpires that opposite party no. 2 refused to accept the notice. Consequent upon, notice as issued by this Court deem served validly upon opposite party no. 2.
3. Upon perusal of record and out of submission, it transpires that petitioner being husband for allegation of committing cruelty upon the informant/opposite party no. 2/wife, namely, Radha Devi was in jail since 18.12.2024 before granting provisional bail on 11.04.2025 and, as such, remains in custody for about five months.

It is pointed out by learned counsel that the second marriage was solemnized by this petitioner out of consent of the informant/opposite party no. 2 they had no child but after solemnizing the marriage with consent of opposite party no. 2, upon tutoring of her parents, the present false case was raised against this petitioner.
5. Considering aforesaid nature of accusation and as petitioner remains in custody for about five months, the provisional bail as granted by this Court vide order dated 11.04.2025 is hereby confirmed with same bailor and bonds.
