JUSTICE ARUN KUMAR ORAL ORDER 07-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 20.3.2018, seeks bail in Pabatta PS Case No. 446 of 2017 registered under Section 392 of the IPC.

The allegation in brief is that some unknown miscreants robbed the informant of six thousand rupees cash, ATM card and other documents.

Learned Counsel for the petitioner submits that the FIR is against unknown, except disclosure of name of the petitioner by coaccused Md. Rizwan there is no other material, neither any incriminating looted article has been recovered from his possession nor he was put on TIP.

Having considered the said facts and circumstances, the petitioner, namely, Balmiki Sharma is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst Khagaria in connection with Parbatta PS Case No. 446 of 2017 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and

Patna High Court Cr.Misc. No.28322 of 2018 (2) dt.07-05-2018 (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
