JUSTICE ARUN KUMAR ORAL ORDER 07-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.2.2018, seeks bail in Phulwari Sharif PS Case No. 777 of 2017 registered under Sections 147, 148, 149, 341, 323, 436, 427, 379 and 504 of the IPC. The allegation in brief is that more than hundred persons turned up and set fire to the house of the informant and others on account of belonging to different religious community.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, merely on suspicion he has been made accused who is a student of Government Polytechnic, Gulzarbagh, he has got no criminal antecedent prior to lodging of the present case but subsequently he has been made accused in five other cases of similar nature and one of the coordinate Bench of this Court has granted bail to other co-accused similarly situated. Having considered the said facts and circumstances, the petitioner, namely, Abhishek Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge XV -cum- ACJM Patna in connection with Phulwari Sharif PS Case No. 777 of 2017.
