The petitioner apprehends his arrest in connection with Bidupur P.S. Case No.68 of 2015 registered under Section 302 and other sections of the Indian Penal Code. As per the first information report, the allegation against the petitioner and his family members is that they assaulted the informant and his mother with lathi and danda due to which his mother died.
It has been submitted on behalf of the petitioner that the Post Mortem Report do not support the allegations made therein. From perusal of the Post Mortem Report, it appears that no external injury has been indicated whereas in the FIR, specific allegation has been made for assault.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts and circumstances, the petitioner, named above, in the event of his arrest/surrender in the
Patna High Court Cr.Misc. No.22017 of 2015 (3) dt.09-07-2015 2/2 court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S.Case No.68 of 2015, subject to condition as laid down under section 438(2l of the Cr.P.C. (Sudhir Singh, J) ahk/- U T
