2. The petitioner seeks bail in connection with Agamkuan P.S. Case No. 326/2024 registered for the offence punishable under Sections 363/366(a)/34 of the Indian Penal Code. After investigation, police filed chargesheet against the petitioner under Section 8/12 of the POCSO Act.
3. The petitioner is the accused of kidnapping the victim girl. He is in jail since 27.05.2024
4. The following statement has been made in paragraph No. 11 of the petition:
"That the daughter of informant has presently resided in the house of the petitioner and
Patna High Court CR. MISC. No.17209 of 2025(2) dt.16-04-2025 2/2 living in full dignity in the house of the petitioner."
5. This application is disposed of with a direction to the court below to verify as to whether the victim girl is living with the petitioner's family or not. If she is found be living with the petitioner's family, the petitioner shall be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Patna / concerned court in connection with Agamkuan P.S. Case No. 326/2024. If the statement is found false, appropriate orders shall be passed.
