The petitioner has prayed for regular bail in a case instituted for the offence under Sections 399 and 402 of the Indian Penal Code and Sections 25 (1-b)A, 26 and 35 of the Arms Act.
As per prosecution case, on secret information received that some miscreants have assembled to commit crime in the house of co-accused Rupesh Kumar, upon which, the informant along with police officials raided the house and apprehended eight accused persons. It is further alleged that one

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. He has committed no offence. Due to high handedness of police, the petitioner has implicated in the present case. He submitted that one loaded country-made pistol and one live cartridge has been recovered from co-accused Suman Kumar Singh. No incriminating article/weapon has recovered from the conscious possession of the petitioner. He further submitted that the others co-accused have already been granted bail by this Bench vide order dated 07.04.2023 passed in Cr. Misc. No. 5340 of 2023 and its analogous cases. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 03.11.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
