The petitioners seek regular bail in connection with Chandan P.S. Case No. 4 of 2018, registered for the offence punishable under Sections 366A, 376, 506/34 of the Indian Penal Code and Section 4 of the POCSO Act.
The allegation is regarding the son of the petitioners having abducted the niece of the informant and thereafter, it is said that the said accused i.e. the son of the petitioners had committed illegal act with the victim girl.
The learned counsel for the petitioners submits that admittedly, there is no allegation of either abduction or committing any illegal act with the victim girl as against the
Patna High Court Cr.Misc. No.28501 of 2018(2) dt.09-05-2018 2/2 petitioners herein which is further apparent from the statement of the victim girl made under Section 164 of the Cr. P.C. The petitioners are in custody since 31.03.2018 and are having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.
Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Chandan P.S. Case No. 4 of 2018. (Mohit Kumar Shah, J) ajay gupta/- U T
