JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Sri Prateek Tandon, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody since 10.3.2018, has prayed for grant of bail in connection with Excise Case No. 121 of 2018, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner at the very outset has drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner was shown to be arrested while he, as a pillion rider, on a motorcycle along with Anil Kumar, owner of the motorcycle, were intercepted by Excise

Patna High Court Cr.Misc. No.28092 of 2018(2) dt.08-05-2018 2/2 Officials and from the said motorcycle about 18 liters of country made Nepali Saufi liquor was shown to be recovered. It has been emphasized that petitioner is having no connection either with the said motorcycle or the seized country made Nepali Saufi liquor .

Be that as it may, considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner Noor Mohammad @ Nur Mohammad Mansoori @ Noor Mohammad be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned 4th Addl. Sessions Judge - cum- Special Judge, Excise, East Champaran, Motihari / concerned court in connection with Excise Case No. 121 of 2018.
