The petitioner is in custody since 28.11.2017 in connection with N.D.P.S. Case No. 10 (A) of 2017 arising out of Barauni Rail P.S. Case No. 73 of 2017 for the offence registered under Sections 414/34 of the Indian Penal Code and Sections 20 and 22 of the NDPS Act, 1985.
Learned counsel for the petitioner submits that the petitioner is named in the first information report on the basis of the confessional statement made before the police by co-accused who was arrested from the place of occurrence with whom 7 tablets of Attivan was recovered. So far as the petitioner is concerned, there is no recovery from him and he has been roped in this case maliciously by the co-accused. It is further submitted that the said co-accused, namely, Md. Miraj with whom such recovery has been made, has since been extended the privilege of bail.
