JUSTICE S. KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Dhangai P.S. Case No. 70 of 2016 registered for the offence punishable under Section 379 of the Indian Penal Code.

The allegation against the petitioner is of committed theft of three buffaloes.

Learned counsel for the petitioner submits that he is not named in the F.I.R., his name was transpired on the basis of confessional statement of co-accused Vicky Yadav. It has further been submitted that petitioner is owner of the pick up van and driver of the same is Vicky Yadav. It has further been submitted

Patna High Court Cr.Misc. No.45077 of 2017 (2) dt.21-09-2017 that similarly situated co-accused Vicky Yadav has already been granted bail by a co-ordinate Bench of this Court passed in Cr. Misc. No. 7133 of 2017 vide order dated 20.02.2017 and he is in custody since 13.08.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Dhangai P.S. Case No. 70 of 2016.
