The petitioner apprehends his arrest in connection with Karja P.S. Case No. 276 of 2020 registered under Sections 272, 273, 308 and 34 of the Indian Penal Code and Section 30(a)/(d) of Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Further submission is that the alleged recovery has been made from the Palani of Phus, as is evident from the seizure list. Petitioner has got no criminal antecedent.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.25784 of 2021(5) dt.12-05-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Karja P.S. Case No. 276 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
