2. The accused/petitioner seeks bail in connection with Nardiganj P.S. Case No. 267 of 2024 registered for the offences under Sections 316(2), 316(5), 318(4), 3(5) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').
3. The accused/petitioner is named in the First Information Report and is in custody since 18.10.2024.
4. As per FIR, the accused persons including the petitioner defalcated the amount/fund of Rs. 18,76,094/- in ward No. 1, Rs. 2,01,609/- in ward no. 2, Rs. 15,78,424/- in ward no. 10, which was granted for development work of the Panchayat/Ward under "Mukhyamantri Saat Nischay Yojana".

5. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner was Ward Secretary of Ward No. 10 of Nanaura Panchayat, Nardiganj Block, District - Nawada. It is pointed out that due to measurement related issue, the present false implication was raised, otherwise almost all work assigned to petitioner under the programme was completed.
6. It is also submitted that petitioner was not the only signatory of cheque for withdrawal of the money, and, therefore, the petitioner cannot be said responsible wholly.
7. While concluding argument, it is submitted that petitioner is a man of clean antecedent, moreover, investigation of this case is already completed and as such, there is no chance of tampering with the evidence.
8. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
9. Considering the facts and circumstances as mentioned above and by taking note of the fact as implication of the petitioner appears prima facie being Ward Secretary of Ward No. 10, coupled with the fact that petitioner is in

No.19583 of 2025(4) dt.28-08-2025 3/3 custody since 18.10.2024, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Nawada, in connection with Nardiganj P.S. Case No. 267 of 2024, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
