Petitioner is languishing in judicial custody since 02.12.2018 in connection with Ghorasahan P.S.Case No.472 of 2018, GR No.1569 of 2018 for the offence alleged under Sections 323, 325 and 498-A/34 of the Indian Penal Code. The prosecution case as lodged on the written report of the informant is that she is married to the petitioner 12 years back and has four children. Since last four years, the petitioner along with her mother-in-law and father-in-law started demanding motorcycle and on 27.11.2018, the petitioner along with her mother-in-law assaulted her with stick, lathi and rod

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent, no such occurrence took place and he has good relation with the informant and is ready to keep her with full dignity and honour. Learned counsel for the informant, however, submits that she is ready to stay with the petitioner, if he keeps her with full dignity and honour.
However, learned APP for the State opposes the prayer for bail.
Considering the nature of the allegations, facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Ghorasahan P.S.Case No.472 of 2018 corresponding to GR No.1569 of 2018 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran, Motihari, subject to the undertaking of the petitioner on an affidavit before the learned court below in future that he will keep the informant with full dignity and honour and if any overt-act is brought to the notice of the learned court below in future, the learned court below would proceed to cancel of the bail
