2. The petitioners apprehend their arrest in connection with Hisua P.S. Case No. 323 of 2024, registered for the offences punishable under Sections 147/ 148/ 149/ 323/ 307/ 447/ 504 of the Indian Penal Code and Section 27 of the Arms Act.

3. Allegedly while the informant along with his son were sitting at his house, in the meantime, all the FIR named accused persons, including the petitioners, came there and started abusing and assaulting. Upon objection, co-accused Mantu Singh gave an iron blow upon the informant and his son.

Patna High Court CR. MISC. No.17771 of 2025(3) dt.14-05-2025 2/3 It is further alleged that co-accused Kundan Singh has also assaulted the informant by stone. There is further allegation against the petitioners that they have threatened with dire consequences and made firing on gate.

Learned Advocate for the petitioners contended that the specific allegation of assault has been levelled against coaccused persons, who have already surrendered and prayed for regular bail; moreover the allegation against the petitioners is of giving threatening and made firing due to which none has sustained any injury. With respect to same occurrence, three FIRs. came to be instituted. There is counter version of the present case being Hisua P.S. Case No. 325 of 2024 against the informant and others. It has been apprised to this Court that one another case has been instituted at the behest of the police personnel making accusation against the persons of both sides. It is next contended that save and except two cases, as noted hereinabove, the petitioners have absolutely clean antecedent

5. On the other hand, learned Advocate for the State vehemently opposed the bail application.

6. Regard being had to the submissions made on behalf of the parties and considering the factum of case and counter case and also the fact that the injuries, which have been

No.17771 of 2025(3) dt.14-05-2025 3/3 allegedly sustained to the informant and his son, have not been attributed to the petitioners, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Nawada in connection with Hisua P.S. Case No. 323 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
