Petitioner who is languishing in judicial custody since 22.03.2017 seeks bail in connection with Amnaur P.S. Case No. 51 of 2017 for offences punishable under Sections 413 & 414/34 of the Indian Penal Code.
The prosecution case, as lodged by the police personnel, is that on information that stolen motorcycle is parked the police apprehended the petitioner along with one other accused Tinkoo Kumar who confessed that the motorcycle was stolen one and had purchased the said motorcycle from co-accused Manjeet Kumar and Dhananjay Mahto. Accordingly, a seizure list was prepared.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and that charge-sheet has already been submitted and the petitioner is
Patna High Court Cr.Misc. No.41355 of 2017 (4) dt.02-11-2017 2/2 languishing in judicial custody since more than seven months. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record as well as the period of custody, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5th Saran at Chapra in connection with Amanaur P.S. Case No.51 of 2017.
