Petitioners are in custody in connection with Sasaram Agrer P.S.Case No.103 of 2018 registered for an offence under Sections 304(B)/34 of the IPC.

The petitioners are parents of the husband of deceased. As per FIR, deceased was married with the son of the petitioners in the year 2012.

Submission of learned counsel for the petitioners is that these petitioners were residing separately from the deceased and her husband having no concern with them. The second son of the petitioners was residing at Sasural along with his wife. The

Patna High Court Cr.Misc. No.30862 of 2018 (3) dt.06-07-2018 2/3 allegation of demand of motorcycle and gold chain is omnibus against the petitioners. These petitioners had no concern with the said demand. The deceased along with her husband was residing at Mumbai and during relevant period they had come at the village. The allegation of torture and assault is omnibus against the petitioners. It appears that the doctor has reported the cause of death due to asphyxia by hanging. The husband of the deceased is in jail custody. The petitioners being parents of the husband are in custody since 30.03.2018 having clean antecedent. The learned APP opposed the submissions.

Considering the aforesaid facts and circumstances, prayer for bail is allowed. Let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Rohtas at Sasaram in connection with Sasaram (Agrer) P.S.Case No.103 of 2018 with following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any

Patna High Court Cr.Misc. No.30862 of 2018 (3) dt.06-07-2018 3/3 genuine reasons, the prosecution is free to move for cancellation of his bail.
