Petitioner apprehends his arrest in a case registered for the offence punishable and u/s 25(1-b)a, 26, 27 of Arms Act. As per the prosecution case, one country made pistol has been recovered from the house of this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that recovery of fire arm has been made from the house of this petitioner.

Patna High Court CR. MISC. No.16307 of 2022(2) dt.27-09-2022 2/2 Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected. If the petitioner surrenders in the court below and prays for regular bail, the same shall be considered on its own merit without being prejudiced from the order of this court.
