====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
3. It is alleged that on 15.7.22, this petitioner along with other F.I.R. named accused persons took away younger son of informant on pretext of some urgent work but he did not return. Thereafter, on 17.7.22, his dead body was recovered from the brick kiln. Informant suspects that the accused persons committed murder of his son.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant is not an eye witness of the occurrence and petitioner has been made accused only on suspicion. Allegation against petitioner is
Patna High Court CR. MISC. No.16980 of 2025(2) dt.16-04-2025 2/2 general and omnibus. Petitioner claims clean antecedent.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is named in the F.I.R. with an allegation that he along with others took away son of the informant and thereafter, his dead body was recovered. Post-mortem report reveals fracture of trachea ring and blood was found in the inner side of neck.
6. Considering the nature of accusation and materials available on record, prayer for anticipatory bail of the petitioner is refused.
