The petitioner apprehends his arrest in Sonepur Rail P.S. Case No. 69 of 2014, registered for the offences punishable under Section 399, 402 and 414 of the Indian Penal Code and under Sections 25(1-B) a/26/35 of the Arms Act. The police got information that some criminals are sitting in a train for committing dacoity. The police raided the place and two accused persons namely Ganesh Mahto and Md. Nazarul were apprehended. Both the accused persons confessed their guilt and disclosed the name of the petitioner and other accused persons. From possession of the apprehended accused different arms and other articles were recovered. The name of the petitioner figured in the case from the mouth of the apprehended
Patna High Court Cr.Misc. No.21316 of 2015 (2) dt.09-07-2015 2/2 accused immediately after being arrested.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
