The petitioner apprehends his arrest in Laxmipur P.S. Case No. 167/2015, registered for the offences punishable under Sections 323, 307, 380, 354, 504, 34 of the Indian Penal Code. The informant alleged that the petitioner and others were sowing seeds in the land of the informant. On protest the accused persons assaulted the informant and others.

It is submitted that no specific allegation of assault is made against the petitioner Ram Bilash Pandit. Similarly situated nine accused persons have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No.54533/2015 and two accused persons vide order passed in Cr. Misc. 9106/2016. Considering the facts aforesaid and the fact that the case

No.16949 of 2016 (2) dt.13-05-2016 2/2 of the petitioner stands on similar footing, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 167/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
