====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Madhepura P. S. Case No. 801 of 2020 lodged under Section 392 of Indian Penal Code.

As per the prosecution case, the offense under Section 392 of Indian Penal Code has been committed by three unknown accused persons.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., his name has figured in this case on the basis of confessional statement of co-accused Prabhakar Kumar and Mithun Kumar. It has been submitted that no T.I.P. has taken place in this case and nothing in discriminatory material has been recovered from the house of petitioner. He further submits that petitioner is in custody since

Patna High Court CR. MISC. No.15293 of 2022(2) dt.06-07-2022 2/2 14.09.2021 and the person who has disclose the name of the petitioner has been granted bail by the co-ordinate Bench of this Court vide order dated 22.04.2022 passed in Criminal Misc. No.65972 of 2021.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 801 of 2020, subject to the following conditions:- The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
