JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sakara P.S. Case No. 61 of 2017 instituted for the offence under Sections-272, 273 of the Indian Penal Code and Section-30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 12 bottles containing 750 ml., 44 bottles containing 375 ml. and 95 bottles containing 180 ml. each of Royal Stag whiskey were recovered from house of this petitioner. The seizure list is enclosed with FIR which does not bear the signature of the petitioner. In paragraph-3 of the petition, it has been mentioned that the petitioner has no criminal antecedent. The petitioner is in custody since 16-06-2017.

In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.37872 of 2017 (2) dt.09-08-2017 amount each in connection with Sakara P.S. Case No. 61 of 2017 to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur subject to condition that both the bailors should be close relative of the petitioner.
