JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Khagaria Police Station Case No. 87 of 2015 registered for the offences punishable under Section 341, 323, 307, 504, 379/34 of the Indian Penal Code.

There is specific allegation against the petitioners no. 1, 2 and 3 that they mercilessly assaulted the informant by iron rod and so far as, petitioner no. 4 is concerned, it is stated that she handed over iron rod to the above stated petitioners and one other F.I.R named accused. The injury report of injured reveals that two

Considering the aforesaid facts and circumstances as well as submissions of the parties, petitioner no. 4 namely, Anita Devi, in the event of her arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Khagaria Police Station Case No. 87 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.

So far as, petitioner nos. 1,2 and 3 are concerned, their prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) Namita/- U T
