Vide order dated 13.12.2016 passed in Cr. Misc. No. 51549 of 2016, petitioner was granted bail, subject to condition that he will appear before the learned court below on each and every date and his failure to appear before the learned court below on two consecutive dates without assigning any reason would entail cancellation of his bail bonds without being prejudiced with this order.

Learned counsel for the petitioner submits that petitioner is working in the Navy, hence, the said condition be modified to the extent that he will appear before the learned court below during trial as and when required and his failure to appear before the learned court below on two consecutive dates without

Patna High Court Cr.Misc. No.38686 of 2018 (2) dt.04-07-2018 2/2 assigning any reason would entail cancellation of his bail bonds. Accordingly, the condition imposed while granting bail vide order dated 13.12.2016 passed in Cr. Misc. No. No. 51549 of 2016 is modified to be read as follows:

"Petitioner will appear before the learned court below during trial as and when required and his failure to appear on two consecutive dates when required without assigning any reason would entail cancellation of his bail bonds". The order dated 13.12.2016 is modified to the extent indicated above.
