21-10-2020 Heard learned counsel for petitioners and learned A.P.P. for the State through video conferencing.

The petitioners apprehend their arrest in Bhagwanpur P.S. Case No. 114 of 2019 registered for the offence under Sections 304(b), 201/34 of the Indian Penal Code. As per the prosecution case, the daughter of the informant was married with co-accused Dhananjay Das in the year 2017. It is alleged that after some time, all the accused persons, including these petitioners, started torturing daughter of the informant in connection with further demand of Rs. Five lacs, as dowry, and on 23-05-2019 at about 6:00 AM, the

Patna High Court CR. MISC. No.16185 of 2020(3) dt.21-10-2020 2/3 informant received an information that his daughter has been killed by her in-laws family members. After getting such information, the informant went to matrimonial house of his daughter, but none of the family members was present there and door of the house was closed. It is alleged by informant that all the in-laws family members of his daughter have killed his daughter and disappeared her dead body.

It is submitted on behalf of petitioners that petitioner no. 1 is mother-in-law of the deceased and is living separately and petitioner nos. 2 & 3 are gotini of the deceased and they are also living separately with their husbands. In support of the same, Annexure -2 has been enclosed with this bail application, which is a certificate of local Mukhiya and Sarpanch as well as Adhar Card of husband of petitioner no. 3 (Annexure -3). It is further submitted that similarly situated co-accused have been granted anticipatory bail by this Court, vide order dated 06-03-2020 passed in Cr.Misc. No. 66436 o 2019. There is general and omnibus allegation. The thrust of accusation is against husband of the deceased. So far as these petitioners are concerned, all are ladies, having clean antecedent, as stated in paragraph - 3 of the petition.

Considering the aforesaid facts and circumstances, the

Patna High Court CR. MISC. No.16185 of 2020(3) dt.21-10-2020 3/3 bail application of petitioners is allowed. In the event of their arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-I, Vaishali in connection with Bhagwanpur P.S. Case No. 114 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
