The petitioner seeks bail in Tajpur P.S. Case No. 118 of 2017 registered under Section 379 of the Indian Penal Code.

As per the prosecution case, the petitioner along with other co-accused is said to have snatched the bag containing Rs. 80,000/- of the informant. The petitioner was apprehended by giving chase by the police while other co-accused managed to escape with the looted money.

It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner. the petitioner has

Patna High Court Cr.Misc. No.38151 of 2017 (2) dt.11-08-2017 2/2 been arrested in utter confusion and misunderstanding as he had gone to village Kasbe Ahaer near Tajpur to attend marriage ceremony . The looted money has been received by the informant which was dumped by the accused during the course of escaping. The petitioner has been languishing in custody since 26.04.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Samastipur in connection with Tajpur P.S. Case No. 118 of 2017.
