In this case, the petitioner is seeking anticipatory bail in connection with Bela P.S. Case No.28 of 2019,registered for the offence under Sections 272, 273, 414 and 120(B) of the Indian Penal Code and under Section 30(a), 38 and 41 of the Bihar Prohibition and Excise Amendment Act, 2018. Huge quantity of liquor has been recovered from a Pick-up van. The name of the petitioner has surfaced during investigation on account of fact that said Pick-up van was standing in the premises of the petitioner.

Looking to the quantity of liquor recovered from the vehicle, this Court is not inclined to grant bail to the

Patna High Court CR. MISC. No.13786 of 2020(3) dt.08-01-2021 2/2 petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court. While passing the order, the Court below will consider the fact that four other co-accused persons have been granted bail as has been submitted by learned counsel for the petitioner.
