JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Gopalganj P.S. Case No.524 of 2014 (G.R. No.3899 of 2014), disclosing offences under Sections 395 and 412 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was not named in the First Information Report and his name surfaced on the basis of confessional
Patna High Court Cr.Misc. No.21424 of 2015 (4) dt.02-02-2016 2/2 statement of co-accused before the police in course of investigation. He further submits that the petitioner has no criminal antecedent.
However, in view of the gravity of offence, I am not inclined to grant the privilege of anticipatory bail to the petitioner, abovenamed, keeping in mind the fact that his custodial interrogation by the police may be required. This application for anticipatory bail is, accordingly, rejected.
The petitioner, abovenamed, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
