Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 341, 379 of the Indian Penal Code. The accusation is of making assault by the petitioners and others to the informant and his two sons. It is submitted by learned counsel for the petitioners that only swelling and lacerated wound of the marginal size have been found during medical examination of the informant and his two sons. The case lodged by the petitioners' side is at earlier point of time and petitioners' side also received injuries. It is further submitted that informant has retracted from the initial version and has filed a petition to that effect before learned Court below. A certified copy of the

Patna High Court Cr.Misc. No.21897 of 2015 (2) dt.23-06-2015 2/2 said petition has been produced. Let it be kept on record. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Raxaul at Motihari in connection with Chhauradano-Mahuawa P.S. Case No. 20 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
