The petitioner apprehends his arrest in Kangali P.S. Case No. 21 of 2014, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The allegation against the petitioner is that he assaulted the informant with an iron rod on the head.
It is submitted that the father of the petitioner is the elder brother of the informant. There is land dispute between the parties and the injuries said to have been caused by the petitioner is simple in nature.
It appears that the petitioner is alleged to have assaulted with iron rod on the head of the informant, I am not inclined to

Accordingly, the prayer for anticipatory bail of the above named petitioner is rejected in connection with Kangali P.S. Case No. 21 of 2014, pending in the court of the learned Chief Judicial Magistrate, West Champaran at Bettiah.
The petitioner is directed to surrender in the court below and the court below shall consider the prayer for regular bail of the petitioner without being prejudiced by the order of this Court taking into account that the blow given by the petitioner caused simple injury and co-accused Sonelal Thakur has already been granted regular bail.
