The petitioner seeks bail in a case instituted under Sections 399, 402, 414 of the I.P.C. and 25(1-B)A/26/35 of the Arms Act. Allegation is that one country made pistol along with four live cartridges has been recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.2.2017. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol along with four live cartridges is said to have been recovered. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

No.42559 of 2017(2) dt.20-09-2017 2/2 Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur in connection with Saraiya P.S. case No.52 of 2017.
