JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 19.7.2017 passed in Cr.Misc.No. 30433 of 2017 with observation to conclude the trial within a period of five months.
Submission of learned counsel for the petitioner is that period of five months has already expired and till date only two witnesses have been examined and have been declared hostile and there was recovery of 3 kg and 150 grams of ganja which is less than commercial quantity and petitioner is in custody since 8.2.2017.
Heard learned APP also.
In the facts and circumstances and also considering the period of custody, let the petitioner, above named, be released on
Patna High Court Cr.Misc. No.31842 of 2018 (2) dt.21-06-2018 2/2 bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, Muzaffarpur, in connection with Karja P.S.Case No. 18 of 2017 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and with further condition that he has to co-operate in disposal of trial.
