JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-09-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Narendra Kumar Singh, learned A.P.P. for the State. Petitioner in the present case is seeking regular bail in connection with Rajpur P.S. Case No. 190 of 2020 registered for the offence punishable under Section 409/120(B) of the Indian Penal Code. He is in custody since 25.12.2020. The petitioner has otherwise no criminal antecedent. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case, from the F.I.R. itself it would appear that the rifle and cartridges of the

No.25475 of 2021(2) dt.24-09-2021 2/3 Home Guard Sri Dinesh Singh and Sri Ram Bachan Singh were found missing and the allegations have been made that they were responsible to keep their arms and ammunitions safely but while saying so the informant has made all the eight Home Guards accused in the F.I.R. on totally false and flimsy kind of allegations.
It is further submitted that several co-accused similarly situated namely Md. Noor Mohammed Ansari, Aash Narayan Kumar and Gyaneshwar Singh have been granted bail by learned coordinate Benches of this Court in Cr. Misc. No. 24756 of 2021, Cr. Misc. No. 24269 of 2021 and Cr. Misc. No. 23990 of 2021.
Mr. Narendra Kumar Singh, learned A.P.P. for the State is present and has opposed the prayer for regular bail of the petitioner but considering the facts and circumstances of the case and that the petitioner is similarly situated with the coaccused who have been granted bail, this Court directs release of the petitioner above named on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bikramganj, Rohtas in connection with Rajpur P.S. Case No. 190 of 2020, subject to the condition as laid down

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
