The petitioner, being the owner of the hotel, is in custody since 27.08.2017 in connection with Bhagwan Bazar P.S. Case No. 311 of 2017 for the offence registered under Sections 3,4, 5,6 and 7 of Immoral Traffic Prevention Act 1956 in which allegedly, certain immoral activities are said to have been committed.

It is stated that the raid team, on some information conducted a raid and certain illegal activity was found there. The Manager of the hotel was found absent and it is alleged that some of the girls reported that the owner of the hotel had lured the girls into the hotel.

Patna High Court Cr.Misc. No.48567 of 2017 (2) dt.17-10-2017 2/2 Learned counsel for the petitioner, however, submits that the owner has nothing to do with any such activity and the entire affairs of the hotel have been placed under the Manager, who has been found to be absent.

Considering the aforesaid facts and circumstances of the case and that nothing illegal and incriminating article has been found from the possession of the petitioner and none of the girls was arrested or have been produced before the Judicial Magistrate for recording their statement, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S.
