====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody in connection with Manjhagarh P.S. Case No. 334 of 2019 for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act 2016. Submission is that recovery of liquor is not alleged from possession of the petitioner rather the person from whose possession recovery of liquor is there, made confession before the police. Petitioner has got identical criminal antecedents. Considering the criminal antecedents of the petitioner, prayer for bail is refused.

Petitioner may renew the prayer for bail before the learned Additional District & Sessions Judge-II, Gopalganj, itself if the charges are not framed within three months from the date of receipt of a copy of this order.
