Petitioner apprehends arrest in connection with Mahua P.S. Case No. 741 of 2022 registered for the offence punishable under sections 414/34 of the Indian Penal Code and Sections 30(a), 32(iii) 34(ii), 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from a pick up van and petitioner is neither the driver nor the owner of the vehicle in question. Petitioner has no concern with the seized article.
