Petitioner is languishing in custody since 09.02.2016 in a case registered for the offences punishable under Sections 323, 341, 504, 506, 498A/34 of the Indian Penal Code.

The basic accusation is of torture.

Learned counsel for the petitioner submits that petitioner disputes the performance of marriage with the informant. The mother of the informant Noor Jahan Khatoon at earlier point of time lodged Bettiah (M) P.S. Case No. 06 of 2013 against Kaushar Equbal & Ors, wherein it has been alleged that Ekbal Alam used to sexually exploit her daughter. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.17024 of 2016 (2) dt.19-04-2016 Considering the inconsistent stand of the informant and her mother and the marriage between informant and petitioner is in dispute, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Bettiah (Mufassil) P.S. Case No. 69 of 2016.
